1. Introduction & Company Information

Welcome to Qstructs Systems ("Company", "we", "our", or "us"), headquartered at 21 Glenara Avenue, Eastlea, Shamba House, Room 11, Harare, Zimbabwe. By accessing our website (https://qstructssystems.com), using our Quick Bricks mobile application, requesting a quotation, or purchasing products and services from either our Building & Construction Supplies division (/bricks) or our Technology & Creative division (/dev), you agree to be bound by these Terms and Conditions.

2. Online Quotations, Pricing & Validity

• Indicative Catalog Prices: Unit prices displayed on our website for bricks, pavers, roofing tiles, ridges, and electronic devices are indicative base prices in United States Dollars (USD) and exclude transport/delivery charges unless explicitly stated.
• Quote Finalization: Submitting a Quote Request via /bricks/quote does not constitute a binding sale until our sales team reviews stock availability, calculates delivery/transport costs to your designated site, and issues a finalized official Quotation (`QUO-YYYY-XXXX`).
• Quotation Validity: Unless otherwise stated on the official PDF Quotation, finalized quotations remain valid for 14 calendar days from the date of issue.

3. Payments & Mobile Money Checkout (Paynow / EcoCash / InnBucks)

• Authorized Payment Channels: Finalized quotations may be paid online via our integrated Paynow Zimbabwe gateway using EcoCash or InnBucks mobile money USSD prompts, or via direct payment methods confirmed with our Harare sales office.
• Payment Confirmation: An order is deemed paid only when Paynow Zimbabwe cryptographically confirms the transaction status as Paid and a valid payment reference is recorded against your quotation.
• Installment Requests: Selecting a 4-month or 6-month installment preference on a quotation request is an expression of interest and remains subject to separate credit approval and a signed installment/lay-by agreement prior to material dispatch.

4. Delivery, Offloading & Risk (Building Materials & Hardware)

• Delivery Scheduling: Delivery timelines are scheduled upon confirmation of payment and depend on order volume and site location within Harare or across Zimbabwe.
• Site Accessibility: Where delivery is requested, the customer warrants that the delivery site is safely accessible by heavy brick delivery trucks. If a delivery vehicle cannot safely access the drop-off point, offloading will take place at the nearest safe accessible point.
• Inspection & Risk: Customers or their designated site representatives must inspect building materials or electronic devices upon delivery and sign the delivery note. Risk of loss or damage passes to the customer upon offloading at the delivery address or collection from our yard.

5. IT Solutions, Custom Software & Branding Services

• Project Scope & Proposals: Managed IT services, custom software development, cybersecurity engagements, and corporate branding projects are governed by project-specific quotations, Statements of Work (SOW), or Service Level Agreements (SLAs) agreed in writing with the client.
• Intellectual Property: Unless otherwise agreed in writing, Qstructs Systems retains ownership of pre-existing software frameworks, tools, and templates. Client-specific deliverables and custom branding assets transfer to the client upon full settlement of all project invoices.

6. Acceptable Website Use & Cybersecurity Compliance (POTRAZ)

In accordance with Zimbabwe's Cyber and Data Protection Act [Chapter 12:07], users of this website must not:

• Attempt unauthorized access to administrative routes (/admin), customer accounts, or payment callback endpoints;
• Use automated bots, scrapers, or scripts to submit fraudulent enquiries, spam blog comments, or manipulate quotation prices;
• Transmit malicious code, Cross-Site Scripting (XSS) payloads, or denial-of-service traffic against Qstructs Systems infrastructure; or
• Post unlawful, defamatory, or infringing content in blog comments. Qstructs Systems reserves the right to moderate or remove any comment prior to publication.

7. Warranties, Returns & Consumer Rights

Nothing in these Terms limits your statutory rights under the Consumer Protection Act [Chapter 14:44] of Zimbabwe. Electronic devices are covered by applicable manufacturer warranties against manufacturing defects. For building and construction materials, any claim regarding specification or transit breakage exceeding industry tolerances must be noted on the delivery note at the time of offloading and reported to sales@qstructssystems.com within 48 hours.

8. Data Protection & Privacy

Your submission of personal information through this website is governed by our Privacy Policy & POTRAZ Data Protection Notice, which forms an integral part of these Terms and Conditions in compliance with the Cyber and Data Protection Act [Chapter 12:07] and Statutory Instrument 155 of 2024.

9. Limitation of Liability & Governing Law

To the maximum extent permitted by Zimbabwean law, Qstructs Systems shall not be liable for indirect, incidental, or consequential damages arising from delays caused by force majeure, telecommunications or mobile money network outages, or improper structural application of building materials not installed by Qstructs Systems. These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Zimbabwe, and any disputes shall be subject to the jurisdiction of the courts of Harare, Zimbabwe.
